These terms of sale govern the sale of advertising spaces (« squares ») on the BrandThisWebsite site, published by Ugo Bittoni (sole trader « Alp'Vision Web », SIRET 924 572 670 00025 — see the legal notice), consisting of 25 spaces each displaying a brand's logo, awarded through bidding.
BrandThisWebsite is a B2B-only service. It is intended for professionals purchasing an advertising space to promote their brand or business, to the exclusion of any purchase for personal purposes. Before confirming a bid or a request, the buyer must expressly declare that they are acting as a professional, for the purposes of their business activity, and provide the name of the brand or business concerned — without this express declaration, no order can be placed.
This declaration is binding on the buyer: if it turns out that a buyer checked this box while in fact acting as a consumer, BrandThisWebsite reserves the right to handle their situation in accordance with the provisions of the French Consumer Code that would then apply, taking precedence over any conflicting clause in these terms.
Each square starts at a base price set by tier (Marquee, Hero, Feature, Starter). Any square — including one already displaying a logo — can receive a higher bid until the deadline shown on the site (« ends in »).
A bid is charged immediately via Stripe the moment it is placed. If a higher bid is subsequently confirmed on the same square, the previous bid is refunded automatically and in full, with no action required.
A bid received within the last 5 minutes before closing automatically pushes the deadline back by 5 minutes, to prevent a last-second bid from winning simply by running out the clock.
At closing, the highest bid on each square wins it for the period stated in section 5. A square that received no bid is not sold.
Sending your logo while you are the leading bid permanently locks in the bid on that square: once the logo is live, that square can no longer be outbid, even before the general deadline.
Displayed prices are in euros, all taxes included. BrandThisWebsite does not charge VAT (VAT exemption for small businesses, article 293 B of the French General Tax Code): invoices issued bear the mention « TVA non applicable, art. 293 B du CGI ».
Payment is made online, by credit card, via Stripe. BrandThisWebsite does not store any card data — it passes exclusively through Stripe, which acts as the payment provider.
Once the winning bid is confirmed (immediately in case of early lock-in, or at auction closing otherwise), the sponsor sends their logo (SVG or PNG) and the desired destination link by email. The square is updated manually, generally within 24 business hours.
The sponsor guarantees that they hold the necessary rights to the logo and materials submitted, and authorizes their display on the site for the duration of the sponsorship.
A won square stays displayed for six months from the date it goes live. The BrandThisWebsite campaign is designed as a one-time event: at the end of the period, the site closes for good. No renewal or « season 2 » is planned at this time.
BrandThisWebsite's bidding mechanism — a direct sale by the publisher, with no auctioneer or third party conducting the award — does not constitute a « public auction » within the meaning of article L221-28, 11° of the French Consumer Code. BrandThisWebsite therefore does not rely on this exception.
The 14-day right of withdrawal provided for by the French Consumer Code does not apply here for a different reason: BrandThisWebsite is a service intended exclusively for professionals (section 1), and every purchase requires the buyer's express declaration that they are acting for the purposes of their professional activity. This right remains fully applicable to any buyer who, in fact, acts as a consumer despite this declaration.
The site is hosted on a personal computer connected to a consumer internet plan (see the legal notice). No guaranteed uptime (« SLA ») is promised, but BrandThisWebsite remains bound to provide the service purchased — the actual display of the square — for the agreed duration, under the conditions described below.
Scheduled maintenance may temporarily interrupt access to the site; reasonable notice is given when possible. BrandThisWebsite maintains regular backups of its data and responds to incidents within a reasonable time given the resources of an individual publisher.
If a technical outage prevents or significantly reduces the display of an already-paid square for more than 48 consecutive hours, BrandThisWebsite compensates for the duration by extending the display of the affected square accordingly, or, if that is not possible (the campaign having already ended), by refunding the undisplayed period on a pro-rata basis.
BrandThisWebsite cannot be held liable for unavailability resulting from force majeure or an event beyond its reasonable control (power grid or internet service provider outage, cyberattack, failure of a third-party provider including Stripe, administrative decision). Its liability for indirect or intangible damages (loss of revenue, reputation, or customers) may be limited to the amount paid by the sponsor for the square concerned; this limitation never applies in the event of gross negligence, willful misconduct, or harm to persons.
BrandThisWebsite cannot be held liable for the content of logos, links, or brands provided by sponsors, each of whom guarantees that they hold the necessary rights to the materials submitted (see section 4).
Data submitted when placing a bid or an application is processed in accordance with the privacy policy.
These terms of sale are governed by French law. In the event of a dispute, the buyer may send a complaint to hello@brandthiswebsite.xyz. Failing an amicable resolution, and subject to the mandatory provisions applicable to consumers, the competent French courts shall have exclusive jurisdiction.
